Supertech is in trouble again with just the other day the Allahabad High Court ordering sealing of more than 1,000 flats in its Supertech Czar residential project developed on plot no. GH-2, sector Omicron 1 of Greater Noida because due approval was not sought for them deeming them illegal construction.
A Division Bench comprising Chief Justice D B Bhosle and Justice Yashwant Verma passed the order following the builder failing to comply with the direction asking to furnish details regarding the number of flats wherein third party rights had already been created and also the number of flats that had already been transferred to respective buyers.
The court has asked the builder to file an affidavit containing all details about ownership and possession of flats before the next hearing due on May 2. Henceforth, the builder has also been restrained from creating third party rights in any of the illegal flats.
The court order was passed in response to a petition filed by VK Sharma and eight other persons who have invested in the project. They have mentioned that there are some 1,904 flats in the project, out of which only 844 flats are legal as per the original plan sanctioned by the Greater Noida Authority. Approval for more than 1,000 of these illegal flats was sought by the builder only after they has already been constructed.
In an earlier order too, the Allahabad HC had asked the Greater Noida Authority to seal illegal villas and flats in the Czar Housing Complex, but the Greater Noida Authority did not follow the order in totality back then. It did seal a couple of these illegal structures, but the majority of them were left out. It would be interesting to see how this latest order is taken by the Greater Noida Authority, now that we have a new person in-charge.
